B & B Country Cafe at 324 W. Garfield was abruptly shuttered Tuesday morning by the State of Kansas.
A sign on the door said the property was seized by the Department of Revenue for nonpayment of taxes. A KDOR press release listed the amount as $204,204.61.
Owner Kimberly A. (Bender) Larios could not be reached for comment.
John Brocker, who owns the building, said he was contacted by the sheriff’s department at 6:30 a.m. Tuesday and was given the opportunity to identify and protect property he owns, which he said includes most of the restaurant’s items.
The state changed the locks and handed the keys to Brocker.
He said he plans to offer the building for rent.
The Larioses have a 48-hour window to make a payment resolution or agreement with the state, according to a KDOR representative.
The state issued five separate tax warrants, with one that dates back to 2009, for the total of $204,204.61.
Another warrant was for withholding tax worth $14,719.76.
The types of assets seized include all known bank accounts, on-site cash, business inventory, as well as personal property belonging to the owner, a press release from KDOR said. The business was sealed closed with a public notice posted on the outside. All seized assets will be sold at public auction and the proceeds will pay for the delinquent taxes.
